Welcome to National Contractor Service (“NCS,” “we,” “our,” or “us”). By accessing or using the NCS website, becoming a member, or utilizing any services offered by NCS, you agree to be bound by these Terms of Service.
1. Purpose of NCS
National Contractor Service is a private membership organization designed to connect contractors, suppliers, service providers, property owners, developers, and other industry professionals through an exclusive business network.
NCS provides members with access to networking opportunities, marketing exposure, educational resources, strategic partnerships, business tools, member benefits, and professional introductions intended to promote business growth.
2. No Guarantee of Work or Revenue
Membership in NCS does not guarantee leads, referrals, jobs, contracts, customers, revenue, profitability, return on investment, business opportunities, or any minimum number of introductions.
NCS makes no representation or warranty regarding the quantity, quality, or value of any business opportunities that may result from membership. Any introductions, referrals, networking opportunities, or business connections are provided solely as potential opportunities.
3. Independent Businesses
Each member operates as an independent business. NCS is not a contractor, subcontractor, employer, staffing agency, broker of construction services, project manager for member projects, or guarantor of member performance.
Members are solely responsible for all contracts, pricing, negotiations, licensing, insurance, permits, taxes, warranties, workmanship, customer communications, and legal compliance.
4. No Responsibility for Member Transactions
NCS is not a party to any agreement entered into between members, homeowners, businesses, developers, or any third party.
NCS assumes no responsibility for payment disputes, construction disputes, defective workmanship, delays, change orders, project performance, collections, contract enforcement, property damage, personal injury, or professional negligence.
5. Membership Benefits
Membership may include listing within the NCS network, business profile visibility, marketing opportunities, networking events, educational content, industry resources, business development tools, strategic introductions, preferred vendor opportunities, member discounts, and industry partnerships.
Benefits may change, expand, or be modified at NCS’s discretion.
6. Exclusive Membership Categories
Where offered, NCS may limit the number of members within a trade, specialty, geographic area, or other category.
Exclusivity applies only to participation within the NCS platform and does not guarantee any amount of work, referrals, market share, or competitive advantage.
NCS reserves the right to establish, modify, or discontinue exclusivity policies.
7. Member Standards
Members agree to maintain all required licenses and registrations, maintain appropriate insurance, operate lawfully and ethically, maintain professional conduct, provide accurate business information, and promptly update changes to licensing, insurance, or ownership.
Failure to meet these standards may result in suspension or termination.
8. Verification
NCS may verify information submitted by members but does not guarantee the completeness or ongoing accuracy of any information. Verification is not a warranty or certification of competence, financial condition, workmanship, or business practices.
9. Member Responsibility
Members are solely responsible for evaluating every opportunity presented through NCS and assume all risks associated with entering contracts, hiring subcontractors, purchasing materials, extending credit, collecting payments, and performing work.
10. Limitation of Liability
To the fullest extent permitted by law, NCS shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from membership, business opportunities, referrals, networking introductions, website use, third-party services, or member interactions.
11. Indemnification
Members agree to defend, indemnify, and hold harmless NCS, its owners, officers, managers, employees, affiliates, and representatives from any claim, lawsuit, demand, liability, loss, cost, or expense arising from their business operations, services, contracts, negligence, legal violations, or interactions with customers or other members.
12. Membership Fees
Membership fees are charged for participation in the NCS network and related benefits. Membership fees are not contingent upon receiving any referrals, leads, projects, or revenue. Unless otherwise stated in writing, membership fees are non-refundable.
13. Right to Refuse or Terminate Membership
NCS reserves the right, in its sole discretion, to approve, deny, suspend, or terminate membership for any lawful reason, including violations of these Terms of Service or conduct that may negatively affect the integrity or reputation of the network.
14. Changes to Services
NCS may modify, add, suspend, or discontinue any feature, benefit, program, pricing, membership category, or website functionality at any time.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey.
16. Entire Agreement
These Terms constitute the entire agreement between NCS and the member regarding use of the website and membership services.
